Section 7 AAC 100.022 - Timely, untimely, and late review applications
(a) A timely review application is one that is received on or before the date requested. If the department determines that a timely review application requires additional documentation, the department will send a notice to the recipient requesting the additional documentation and giving the recipient at least 10 days after the date of the notice to submit the additional documentation. If eligibility is found after reviewing the review application and any additional documentation timely received, the department will determine a new review due date in accordance with 7 AAC 100.020. If the department determines that the recipient is not eligible, or if the requested documentation is not received on or before the due date, the department will send the recipient a notice that, starting the first day of the month immediately after the date of that notice, the recipient will no longer be eligible for Medicaid.
(b) An untimely review application is one that is not received on or before the date requested, but is received on or before by the last day of the month eligibility is set to end according to the notice under (a) of this section. If the department determines that an untimely review application requires additional documentation, the department will send a notice to the recipient requesting the additional documentation and giving the recipient at least 10 days after the date of the notice to submit the additional documentation. If the department is unable to determine eligibility on or before the last day of the month in which eligibility is set to end, the department will extend eligibility one month to allow time for the department to complete its determination of whether the recipient is eligible for benefits. If eligibility is found after reviewing the review application and any additional documentation timely received, the department will determine a new review due date in accordance with 7 AAC 100.020. If the department determines that the recipient is not eligible, or if the requested documentation is not received on or before the due date, the department will send the recipient a notice that, starting the first day of the month immediately after the date of that notice, the recipient will no longer be eligible for Medicaid.
(c) A late review application is one that is received after the month the recipient's Medicaid eligibility has ended. If the review application is received
(1) in the month following the month the recipient's eligibility ended, the late review application will be accepted, but will be treated as a new application for Medicaid and the applicant must meet all requirements of a new applicant, except that an interview is not required; and
(2) more than one calendar month after the recipient's eligibility ended, the department will not accept the late review application; if the department does not accept the late review application under this paragraph, a recipient must submit a new application.
