Section 7 AAC 57.035 - Grounds for nonrenewal or revocation of license(a) For purposes of AS 47.32.050 and 47.32.060, in addition to the ground of violation of AS 47.32, 7 AAC 10.1000 - 7 AAC 10.1095, or this chapter, the department may revoke or decline to renew a license issued under this chapter on one or more of the following grounds: (1) the child care facility fails to submit a timely and complete renewal application;(2) the licensee, administrator, a member of the licensee's household, or other individual associated in a manner described in 7 AAC 10.900(b)(A) is one for whom the department determines under 7 AAC 10.900 - 7 AAC 10.990 (barrier crimes and conditions: background checks) that a barrier crime or condition exists, unless the department grants a redetermination under 7 AAC 10.927 or grants a variance under 7 AAC 10.930 and 7 AAC 10.935; or(B) is charged with, convicted of, found not guilty by reason of insanity for, or adjudicated as a delinquent for a crime or offense listed in 7 AAC 10.905, unless the department grants a redetermination under 7 AAC 10.927 or grants a variance under 7 AAC 10.930 and 7 AAC 10.935;(3) the child care facility obtains or attempts to obtain or retain a license under this chapter by fraudulent means, misrepresentation, or by submitting false information;(4) the department's report of investigation or inspection under AS 47.32.120 concludes that the department has reason to believe that a violation of an applicable statute or regulation has occurred that presents an immediate danger to the health, safety, or welfare of an individual receiving services from the entity;(5) the child care facility fails to correct a violation noted in a report of investigation provided under AS 47.32 and 7 AAC 10.9600 - 7 AAC 10.9620;(6) the child care facility fails to comply with a final administrative order issued under AS 47.32.(b) A child care facility may voluntarily relinquish its license or withdraw an application for renewal.Eff. 6/23/2006, Register 178; am 2/9/2007, Register 181; am 6/29/2017,Register 222, July 2017Authority:AS 44.29.020
