Section 7 AAC 54.350 - Disclosure of information on delinquent juveniles; notification of school
(a) Subject to AS 47.12.310, and in implementing that statute, the division shall disclose appropriate information concerning a juvenile, acquired while the juvenile was subject to court jurisdiction under AS 47.12 to
(1) a parent or guardian of the juvenile, upon the parent or guardian's request when
(A) the information has been procured as part of a court-ordered evaluation program;
(B) the information is necessary to the parent or guardian's participation in court-ordered treatment;
(C) the information is necessary to allow the parent to exercise residual parental rights as provided in AS 47.12.150(c); or
(D) the court has ordered that the information be disclosed;
(2) a court custody investigator when a juvenile is the subject of a court proceeding in which a guardian ad litem or court custody investigator is appointed; and
(3) a person or agency asked to provide consultation or services for a juvenile.
(b) In implementing AS 47.12.310(b)(2)(C) to protect the juvenile, other school students, and staff, the division
(1) shall notify school administrative staff if there is cause to believe that a juvenile may pose a safety concern to other school students or staff; and
(2) may notify school administrative staff of safety concerns in other situations after considering
(A) whether the minor's offense was against a person or property;
(B) whether individuals are potentially at risk; and
(C) the minor's prior offense history.
