Section 7 AAC 45.390 - Income of SSI and APA recipients
(a) Except as provided in 7 AAC 45.515, the department will disregard all of the income of an individual who is
(1) actually receiving supplemental security income (SSI), adult public assistance (APA), or both;
(2) living in a household that contains an assistance unit; and
(3) a member of the economic unit.
(b) Except as provided in 7 AAC 45.515, if a household contains members who receive SSI or APA and other members who are included in an assistance unit, the department will treat each group of recipients as completely separate economic units, regardless of the relationships between those individuals. An individual may not receive ATAP benefits and either SSI or APA benefits for the same month.
(c) Except as provided in 7 AAC 45.515, the total amount of income that, for the purposes of SSI or APA, is treated as belonging only to the recipient of SSI or APA, is not income for the purpose of calculating ATAP benefits.
(d) A recipient or applicant shall notify the department within 10 days after a member of the applicant's or recipient's economic unit or assistance unit begins receiving SSI benefits.
(e) If a stepparent, parent of a minor parent, disqualified alien parent, or alien's sponsor, receives SSI benefits, the department will not consider the income of that individual to be available to the stepchild, minor parent, disqualified alien parent's child, or sponsored alien.
