Section 7 AAC 45.271 - Reporting child's absence from home
(a) In addition to the reporting requirements in 7 AAC 45.270, a caretaker relative shall report a dependent child's absence from the home within five days after the date that it becomes clear to the caretaker relative that the dependent child will be absent from the home for more than one month. This report may be submitted
(1) in person, in a signed and dated writing;
(2) by phone; or
(3) by electronic means approved by the department.
(b) If a caretaker relative fails, without good cause, to report a child's absence from the home as required by (a) of this section and the absence is not allowable under 7 AAC 45.225, the relative is subject to a determination of an intentional program violation described in 7 AAC 45.580 and disqualification for failing to disclose a material fact under AS 47.27.015(e).
(c) For purposes of this section, "good cause" means a circumstance beyond the caretaker relative's control that prevents the relative from submitting a timely report, and includes
(1) a physical or mental illness or incapacity that is severe enough and long enough to prevent timely reporting;
(2) illiteracy; and
(3) failure of the mail to be timely delivered, if the relative can document the circumstance as the cause of the failure.
