Section 7 AAC 23.110 - Scope
(a)7 AAC 23.100 - 7 AAC 23.220 describe the program for children with disabilities. Under that program, the department will refer children to health care providers for diagnosis and treatment or management of conditions that cause children to have disabilities.
(b) Under the program for children with disabilities, the department will pay a cost of medical care for a child with a disability if
(1) an eligible person has properly applied for assistance as required by 7 AAC 23.120;
(2) the child is an eligible child as described in 7 AAC 23.130;
(3) the condition that causes the child to have a disability is an eligible condition as described in 7 AAC 23.140;
(4) the cost is for an eligible service described in 7 AAC 23.150;
(5) the department has referred the child to a provider and authorized the care giving rise to the cost as required by 7 AAC 23.160;
(6) the child and the child's family have exhausted all alternative resources as required by 7 AAC 23.170;
(7) the child and the child's family have agreed to pay a participation amount as required by 7 AAC 23.180; and
(8) sufficient money has been appropriated to pay the cost, and the total costs paid on the child's behalf under the program during any state fiscal year does not exceed $20,000, except as provided in 7 AAC 23.190.
