Section 7 AAC 05.705 - Out-of-institution birth documentation
(a) When a birth occurs in this state outside of a hospital or other institution, and the certificate of birth is requested to be filed before the first birthday of the child, the bureau will require additional evidence as set out in (b) of this section before accepting the filing of the certificate.
(b) The person responsible for filing the certificate of birth shall submit the additional evidence acceptable to the bureau as follows:
(1) evidence of pregnancy, including
(A) the prenatal medical record;
(B) a statement from a physician or other health care provider qualified to determine the pregnancy; or
(C) a home visit by a public health nurse or other health care provider concerning the pregnancy;
(2) evidence that the child was born alive, including
(A) a statement from the physician or other health care provider who saw or examined the child; or
(B) an observation of the child during a home visit by a public health nurse or other health care provider;
(3) evidence of the mother's presence in this state on the date of the birth, including
(A) if the birth occurred at the mother's place of residence in this state,
(i) a driver's license, or a state-issued identification card, that includes the mother's current physical address of residence on the face of the license or card;
(ii) a rent receipt that includes the mother's name and physical address of residence; or
(iii) a utility, telephone, or other bill that includes the mother's name and physical address of residence;
(B) if the birth occurred in the state, but not at the mother's place of residence, an affidavit from a tenant or a witness on the premises when the birth occurred in this state, affirming that the mother was present on those premises at the time of the birth; for the bureau to accept the affidavit under this sub-subparagraph, the affidavit must include evidence similar to that specified in (3)(A) of this subsection concerning the affiant's being on the premises and the mother's presence in this state on the date of the birth.
(c) If evidence specified in this section is unavailable, the bureau may accept other evidence of a similar type on which a state registrar would rely to document the required information.
