Section 3 AAC 30.200 - Workers' compensation review and advisory committee
(a) The director will appoint a 10-member workers' compensation review and advisory committee to assist and advise the director regarding workers' compensation matters. The director will appoint a secretary to maintain minutes of all meetings, send notice of all meetings as required under (d) of this section, and provide necessary support and assistance to the committee. The secretary is not required to be a member of the committee.
(b) Membership of the committee must include
(1) executive level personnel representing the five insurers that consistently write the largest volume of workers' compensation premiums in the voluntary market in this state;
(2) two Alaska licensed resident insurance produces;
(3) representatives of two insured Alaska employers that have workers' compensation coverage in the voluntary market; and
(4) a representative of one insured Alaska employer that currently has or has had within the last three years workers' compensation coverage through the assigned risk pool.
(c) Members of the committee shall serve staggered three-year terms at the pleasure of the director. A chairperson and vice-chairperson shall be selected by the membership annually by majority vote. The chairperson or vice-chairperson, with the assistance of the secretary, shall work with the division to establish the agenda for each meeting or hearing, arrange for meeting facilities, provide notice as required under (d) of this section, and conduct each meeting or hearing.
(d) A meeting of the committee may be called by or at the request of the chairperson, the director, or upon written request of three members. A notice stating the time, place, and purpose of the meeting must be sent to each member and the director at least 10 days before the date of the meeting. Regular meetings must be scheduled at least quarterly must take place in this state, and are oncn to the public. A person may participate telephonically. Five members constitute a quorum for the committee to conduct business at any meeting. The director will consider acts of a majority of the voting members present to be the acts of the committee as a whole.
(e) The committee is not directly involved in the review and approval of rate, rule, or form filings submitted to the director under AS 21.39.041 or AS 21.42.120. However, a rating organization shall share with the committee details of any proposed filing under AS 21.39.041 or AS 21.42.120 before it is submitted to the director, unless the director waives this requirement. Nothing in this subsection restricts the advice or actions of the committee to matters related to rating organization rate, rule, or form filings.
