An independent review organization, a clinical reviewer working on behalf of an independent review organization, or an employee, agent, or contractor of an independent review organization may not be liable in damages to a person for an opinion rendered, or act or omission performed, within the scope of the duties of the organization, the clinical reviewer, or an employee, agent, or contractor of the organization under 3 AAC 28.950 - 3 AAC 28.982 during, or upon completion of, an external review conducted under 3 AAC 28.950 - 3AAC 28.982, unless the opinion was rendered, or the act or omission was performed, in bad faith or involved gross negligence.
