Section 22 AAC 20.605 - Application for special medical parole(a) An application for special medical parole must include the following items, submitted to the board through the department's assigned parole officer: (1) a report of the prisoner's recent institutional status;(2) documentation of the prisoner's medical condition;(3) a plan for release of the prisoner and for any treatment of the prisoner after release;(4) a copy of the court judgment and order of commitment for the current offense for which the applicant is incarcerated;(5) the pre-sentence investigation report;(6) the time accounting record;(7) at the board's request, any additional information that the board considers relevant to determining eligibility for special medical parole.(b) The board may request the department to prepare a parole progress report when a prisoner applies for special medical parole. In preparing the report, the department shall use any special format established by the board and any forms provided by the board for special medical parole. The department shall provide the requested documents to the board at least one week before the week of the scheduled board hearing. However, for emergency special medical parole hearings, the board will advise the department of the timeframe for submission of the requested documents.(c) An applicant for special medical parole must provide the board and the department with full access to all medical records, and must sign a release assuring that access by the department and the board for the full duration of the period of parole. Upon request of the board, the department shall obtain verification of the applicant's medical condition and treatment plan from a physician and provide this information to the board.(d) The department shall provide the applicant with a copy of all reports and attachments, and access to other records to be considered by the board, except those made confidential by law.Eff. 3/29/2003, Register 165Authority:AS 33.16.060
