Section 22 AAC 05.540 - Access to law library and law library materials(a) A prisoner must have access to law library materials, including, at a minimum, current constitutional, statutory, and case law materials, applicable court rules, and practice treatises.(b) A facility shall provide a prisoner with timely access to the law library, library assistance, and supplies for preparing legal pleadings.(c) A facility may not impose restrictions on the use of law library materials, except for those interferences normally and routinely imposed by the requirements of the security and the daily schedule of the facility.(d) A prisoner confined in segregation or in maximum security must be allowed access to law library materials, unless the superintendent or assistant superintendent determines that the prisoner presents a substantial threat to the security and order of the facility, or unless the prisoner is in punitive segregation. Facility staff may bring legal materials to the prisoner's cell, escort the prisoner to the law library, or make photocopies of legal materials and allow access by the prisoner. If a prisoner is not permitted to use law library materials in accordance with this subsection, the prisoner is entitled to have up to 10 legal briefs or law documents in that prisoner's cell at any one time.Eff. 9/10/77, Register 63; am 1/9/87, Register 101; am 12/1/2006, Register 180Authority:AS 33.30.011
