Section 20 AAC 30.980 - Appeal procedures
(a) An applicant may formally appeal an advisory panel's recommendation to the council by submitting a letter postmarked within 14 days of receipt of notification of the panel's recommendation. An applicant must address the formal appeal letter to the council. The council will consider an appeal only if one or more of the following are alleged:
(1) the application was reviewed using criteria other than those appearing in this chapter;
(2) a decision or recommendation was influenced by a panel member with a conflict of interest; or
(3) erroneous information was provided at the time of review by a staff member, panelist, or council member.
(b) If, upon review of the appeal, the executive director determines that the allegation may be substantive, the executive director will forward the appeal to the council for review and disposition. A council decision on an appeal is a final agency decision, and may be appealed under the provisions of Rule 602(a) Alaska Rules of Appellate Procedure.

Effective 7/1/2011, Register 198, the Alaska State Council on the Arts readopted 20 AAC 30.980 to affirm the validity of that section after statutory amendments made in ch. 30, SLA 2010. Chapter 30, SLA 2010 made explicit the council's authority to adopt regulations consistent with AS 44.27.052(a)(6).
