Section 20 AAC 05.425 - Application and annual renewal of interim-use permit
(a) Application for the issuance or renewal of an interim-use permit must be made to the commission on a form provided by the commission. If the application is submitted by mail or electronic imaging, the application must be signed by the applicant or by an agent authorized in accordance with 20 AAC 05.1960. An applicant may submit an application to renew an interim-use permit on the online licensing system at the commission's website. The total annual fee for the permit or permits being applied for or renewed must be submitted with the application.
(b) Repealed 11/26/87.
(c) Fees submitted for an interim-use permit for a specific fishery will be refunded only in the event of a season-long administrative closure of the fishery. However, the commission may; refund fees if the commission finds that a circumstance applicable to all permittees in that fishery has prevented a substantial number of permittees from participating. The commission may refund fees if the permittee erroneously applied for the wrong permit for the permittee's intended fishing activities during the season and did not try to participate in the fishery with the erroneous permit. A permittee may request a refund described in this subsection by submitting a written request to the commission that specifies the circumstances relevant to the request. The permit card or compelling evidence of the destruction of the permit card must accompany the request. The commission may require an applicant to submit additional affidavits or other evidence in support of a request for refund.
(d) Before the commission will issue an interim-use permit card in a given year, the annual renewal form submitted to the commission must show the ADF&G number of the vessel on which the card is to be used, and, except when excused for good cause or exempt by law, the vessel so designated must be licensed for that year.
(e) A person applying for or renewing an interim-use permit who needs to fish immediately, and has not yet renewed, applied for, or paid the current year fees for an interim-use permit, may instead apply using the Application for Immediate Fishing form provided by the commission. The application form may be used for fishing only if the form has been submitted to the commission through commission staff or an agent of the commission who has certified the form is complete by signing it. The signed application form may be used for fishing for no more than the 14 days immediately following the date that the form is signed by commission staff or an agent of the commission, unless extended by the commission. In addition to the total annual fee for the permits and vessel licenses being applied for, a processing fee of $80 must be submitted with the application. The commission may waive the processing fee for
(1) an applicant who qualifies for the reduced permit fee in accordance with 20 AAC 05.245; or
(2) good cause shown.
(f) For the purposes of receiving and certifying as complete an Application for Immediate Fishing form submitted under (e) of this section, an employee of the Department of Fish and Game or the division in the Department of Public Safety responsible for the enforcement of laws for the protection of fish and wildlife, is an agent of the commission.
