Section 18 AAC 80.1915 - Public interest waiver(a) The department will waive a fee for performing an inspection or analysis under this chapter if the department finds that(1) after conducting an inspection or analysis in response to a complaint, the complaint was unfounded;(2) a public health or environmental emergency exists, and an inspection or analysis at no cost to the owner is needed to meet the emergency; or(3) an inspection or analysis is necessary to prevent a public health or environmental emergency, and charging a fee for that inspection or analysis would not be in the public interest.(b) A circumstance listed in (a) of this section does not constitute an automatic fee waiver.Eff. 10/1/99, Register 151; am 4/24/2009, Register 190; am 7/25/2010, Register 195Authority:AS 44.46.025
