Section 18 AAC 72.030 - Pit privies
(a) A person may install and use a pit privy without the approval of the department if the pit privy
(1) is at least 100 feet, measured horizontally nearest edge to nearest edge, from
(A) the mean annual high water level of a lake, river, stream, spring, or slough; or
(B) the mean higher high water level of tidally influenced coastal waters;
(2) meets the minimum separation distance requirements in 18 AAC 72.100 for private water systems;
(3) meets the minimum separation distance requirements in 18 AAC 80 for a public water system;
(4) is located in an area not prone to flooding or in wetlands;
(5) is constructed such that the minimum vertical separation distance between the lowest portion of the pit privy to the annual high water table is four feet; and
(6) is protected from precipitation and animal or insect contact by a protective shelter over the privy.
(b) Only human urine and excrement that is not waterbome may be disposed of in a pit privy.
(c) A pit privy must be decommissioned when solids are within two feet of the ground surface or if the pit privy is permanently inactive or abandoned. The pit privy must be decommissioned by removing the structure described in (a)(6) of this section, spreading powdered lime evenly in the hole, and then backfilling with sand or silt soils, compacted, and slightly mounded above the surrounding ground surface.
