Section 18 AAC 69.060 - Notification and reporting requirements for discharge necessary for the safety of the vessel or saving life at sea
(a) If wastewater is discharged from a commercial passenger vessel into the marine waters of the state for the purpose of securing the safety of the vessel or saving human life at sea, the owner or operator shall notify the department within 24 hours after the discharge, of the
(1) name of the vessel;
(2) date and time when the discharge occurred;
(3) amount and type of wastewater discharged; and
(4) the location, in latitude and longitude, of the vessel when the discharge occurred.
(b) Unless the department determines that a written or electronic report is not needed for the department to ascertain any threat to human health, safety, or welfare, or to the environment, a written or electronic report must be submitted within five days after the event causing the need to discharge ends.
(c) A report under (b) of this section must
(1) be submitted to the department's Anchorage or Juneau office, whichever is nearest to the location of the discharge; and
(2) contain, as applicable,
(A) the date and time of the discharge;
(B) the latitude and longitude of the vessel when the discharge occurred;
(C) the name of the vessel;
(D) the name, mailing address, and telephone number of the master of the vessel;
(E) the type and estimated amount of wastewater discharged;
(F) an explanation of why the discharge was necessary to secure the safety of the vessel or save a life at sea;
(G) a description of the precautions taken to prevent or minimize the discharge; and
(H) other information that the department requires to assess fully the ability of the owner or operator to prevent or minimize the discharge.
