Section 18 AAC 64.010 - Placement
(a) The minimum number of receptacles required in each public place under 18 AAC 64.005 is as follows:
(1) along public highways, one receptacle at each rest area or scenic view point officially designated as such by the authority with jurisdiction over maintenance of the highway;
(2) in parks and recreation areas accessible by road, one receptacle at each established trailhead leading from the central activity area, and one receptacle for each restroom, picnic table, and drinking fountain, except that fewer receptacles in the central activity area will be allowed if the total capacity of those receptacles is at least ten gallons times the number of restrooms, picnic tables and drinking fountains;
(3) at campgrounds and trailer parks for transient use, one receptacle for each unit or space designated for setting up a recreation vehicle or for camping, except that fewer receptacles will be allowed if the total capacity of those receptacles is at least ten gallons times the number of units or spaces;
(4) at service stations, one receptacle for each fuel pump island;
(5) outside fast-food restaurants, self-service refreshment areas, taverns, grocery stores, and shopping malls, one receptacle within 50 feet of each public exit;
(6) in parking lots for more than 50 vehicles, one receptacle plus one receptacle for each additional 200 parking spaces;
(7) at marinas, boat launching areas, marinas, fueling stations, piers, docks, and small boat harbors accessible by road, one receptacle;
(8) on central business district sidewalks in cities and organized boroughs, one receptacle every 800 feet on each side of the street, placed by the unit of local government responsible for litter removal, except that the local government may count receptacles placed by other persons to meet the requirements of this section;
(9) at each bus stop described in 18 AAC 64.005(a) (10), one receptacle;
(10) at schoolgrounds, one receptacle at each bus loading zone; and
(11) at sites for sporting events, fairs, carnivals, circuses, festivals, and other similar public events, and one receptacle at each exit, plus onsite receptacles with a total capacity of 10 gallons for each 500 persons expected to attend daily.
(b) The department will, in its discretion, grant variances from the provisions of this section when a requester shows that it has a viable in-place litter control program.
(c) A public place with a frequent accumulation of uncontained litter is considered to have an insufficient number of receptacles or an insufficient collection frequency, and the department will, in its discretion, impose additional requirements.
