18 Alaska Admin. Code § 50.750
Notwithstanding the other requirements of 18 AAC 50.700 - 18 AAC 50.750, highway and transit projects of the types listed in Table 2 of 40 C.F.R. 93 .126, revised as of July 1, 20 13, and adopted by reference, are exempt from the requirement to determine conformity. Those projects may proceed toward implementation even in the absence of a conforming transportation plan and transportation improvement program . A particular action of the type listed in Table 2 of 40 C.F.R. 93. 126 is not exempt if the agencies listed in 18 AAC 50.715(a)(2) concur that it has potentially adverse emissions impacts for any reason. Metropolitan planning organizations must ensure that exempt projects do not interfere with transportation control measure implementation.
