Section 17 AAC 95.060 - Sole source procurements
(a) The authority may restrict a procurement to one potential contractor if no other source is suitable or acceptable to meet the need. The authority may conduct a sole source procurement under this section if the authority determines that only one qualified proposer has responded to a request for qualifications under 17 AAC 95.040(b) (6), or if all other short-listed proposers have withdrawn from the procurement process under 17 AAC 95.040.
(b) The executive director shall prepare and sign a written finding and determination that there is only one source for the required procurement. For a procurement of $100,000 or more, final approval for the sole source procurement must be obtained from the board.
(c) The authority will conduct negotiations as to price, delivery schedules, and terms of a sole source procurement. The executive director shall make a written determination of fairness and reasonableness of price, for inclusion in the procurement file, before award of a sole source procurement.
(d) The authority will include in the procurement file for each sole source procurement the executive director's written finding and determination, and the executive director's or board's final approval, described in (b) of this section. The authority will maintain for each sole source procurement a record that includes at least the following information:
(1) the contractor's name;
(2) the amount and type of the procurement; and
(3) a listing of the supplies, equipment, services, construction, office or other space leases, personal property, and professional services procured under the contract.
