Section 13 AAC 75.070 - Loss of eligibility(a) The eligibility of a surviving spouse to receive medical insurance premium payments ends upon the earlier of the date the surviving spouse: (1) becomes eligible for Medicare under 42 U.S.C. 1395j- 1395w-6;(2) becomes eligible to receive alternative major medical insurance coverage, regardless of cost; or(3) has received premium payments for 10 years, except that the 10-year time limit will not expire while a surviving spouse is parenting a surviving dependent child who is receiving the premium payments;(b) The eligibility of a surviving dependent child to receive medical insurance premium payments ends upon the earlier of the date the dependent child: (1) becomes eligible to receive alternative major medical insurance coverage, regardless of cost; or(2) reaches 26 years of age. This subsection shall not apply to a child that is totally and permanently disabled as determined by the department.(c) When eligibility ends, the department will stop paying premium payments on behalf of the surviving dependent and notify the employer's insurance company.Eff. 1/26/2018,Register 225, April 2018Authority:AS 44.17.030
