Section 13 AAC 75.040 - Eligibility requirements(a) To be eligible to receive medical insurance premium payments beyond the period of presumed eligibility, a surviving dependent must submit a completed application to the department and provide each of the following: (1) a death certificate of the deceased peace officer or firefighter;(2) proof that the peace officer's or firefighter's death was proximately caused by an injury sustained or hazard undergone while in the performance of and within the scope of the employee's duties, and the injury or hazard was not the proximate result of the willful negligence by the employee;(3) proof that at the time of death, the peace officer or firefighter was employed by a participating employer in a full-time, year-round position;(4) proof of the receipt of medical insurance benefits by the surviving dependent through the peace officer's or firefighter's employer-sponsored medical insurance coverage prior to the death of the peace officer or firefighter;(5) proof that the surviving spouse was legally married to the peace officer or firefighter at the time of the peace officer's or firefighter's death and is not eligible to receive major medical insurance coverage through other means; except that if the peace officer's or firefighter's death occurred before June 26, 2015, and if the applicant can prove the applicant was cohabiting with the peace officer or firefighter in a continuing, exclusive same-sex relationship at the time of the death, and can meet the other eligibility requirements in this section, proof of legal marriage is not required; and(6) proof that for each surviving dependent child for whom payment of medical insurance premium payments is sought the dependent child is:(A) the peace officer's or firefighter's child by birth, adoption, or stepchild status;(B) is under 26 years of age or, if 26 years of age or older, is totally and permanently disabled; and(C) is not eligible to receive major medical insurance through other means.Eff. 1/26/2018,Register 225, April 2018Authority:AS 44.17.030
