Section 11 AAC 20.990 - Definitions
(a) In AS 41.23 and this chapter, "ordinary high water" means that line or mark on the shore of a non-tidal river or stream that reflects the highest level of water during an ordinary year and is established by fluctuations of water and indicated by one or more of the following physical characteristics:
(1) a clear, natural line impressed on the bank;
(2) shelving;
(3) changes in the character of soil;
(4) destruction of terrestrial vegetation;
(5) the presence of litter and debris; or
(6) other appropriate means that consider the characteristics of the surrounding area.
(b) In AS 41.23.200(d)(1) and this chapter, "airboat" means a shallow-draft boat driven by an airplane propeller and steered by a rudder.
(c) In this chapter,
(1) "anadromous streams" means those water bodies identified by the Department of Fish and Game under 5 AAC 95.011;
(2) "boat" or "vessel" has the meaning given in 11 AAC 12.990;
(3) "camp" or "camping" has the meaning given in 11 AAC 12.990;
(4) "campground" has the meaning given in 11 AAC 12.990;
(5) "client day" means any portion of a day in which a person is receiving commercial services permitted under 11 AAC 18.010 on state park land or water;
(6) "developed facility" has the meaning given in 11 AAC 12.990;
(7) "director" means the director of the division, or the director's authorized agent;
(8) "division" means the Division of Parks and Outdoor Recreation, Department of Natural Resources;
(9) "drainage" has the meaning given in 11 AAC 12.990;
(10) "drift fishing channel" means a channel commonly used by boats drifting downstream with the current;
(11) "firearm" has the meaning given in 11 AAC 12.990;
(12) "guide services" has the meaning given in 11 AAC 12.990;
(13) "Hatcher Pass East Management Area" means the state lands described in AS 41.23.130, Hatcher Pass Management Area Plan, and within the Little Susitna River watershed, including Summit Lake State Recreation Site and Independence Mine State Historic Park;
(14) "hovercraft" means a vehicle supported above the surface of land or water by a cushion of air produced by downward-directed fans;
(15) "hydroplane" means a speed boat with hydrofoils or a stepped bottom, so that the hull is raised wholly or partially out of the water allowing it to skim along the water at a high rate of speed;
(16) "natural resources" has the meaning given in 11 AAC 12.990;
(17) "off-road vehicle" has the meaning given in 11 AAC 12.990;
(18) "permit" has the meaning given in 11 AAC 12.990;
(19) "personal watercraft" means a vessel that is
(A) less than 16 feet in length;
(B) propelled by a water-jet pump or other machinery as its primary source of motor propulsion; and
(C) designed to be operated by a person sitting, standing, or kneeling on the vessel, rather than by a person sitting or standing inside it;
(20) "primary traffic channel" means a channel of a river commonly used by motorized boats for travel;
(21) "professional guide services" has the meaning given in 11 AAC 12.990;
(22) "snowmobile" has the meaning given in 11 AAC 12.990;
(22) "sport fishing guide" has the meaning given in 11 AAC 12.990;
(23) "state park" means any land or water managed by the division;
(24) "structure," except as provided in 11 AAC 20.367, has the meaning given in 11 AAC 12.990;
(25) "tethering" means fastening or restraining an animal so that it can range only within a set radius;
(26) "traffic control device" has the meaning given in 11 AAC 12.990;
(27) "vehicle" has the meaning given in 11 AAC 12.990;
(28) "weapon" has the meaning given in 11 AAC 12.990.
