Section 11 AAC 16.230 - Procedures

When a property has been identified as potentially eligible for nomination to the National Register of Historic Places, the following procedures will be followed for notification of property owners and affected federal, state, and local government agencies which have an interest in the property.

(1) When a decision has been made to compile information on a property for the purpose of preparing a nomination to the National Register of Historic Places, a letter will be sent to the property owner explaining that his property is being studied, what the National Register program comprises, and, if a nomination form is drafted, that a draft will be sent to him before its presentation to the Historic Sites Advisory Committee. The letter will request permission from the owner to visit the site under study.
(2) At the time the letter described in (1) of this section is sent to the property owner, or as soon thereafter as practicable, but in no circumstances less than 60 days before the date it is anticipated that the nomination will be presented to the Historic Sites Advisory Committee, a statement of the intended nomination will be sent to the clearinghouse in the Office of the Governor for circulation to concerned public agencies.
(3) No less than 30 days before the date it is anticipated that the nomination will be presented to the Historic Sites Advisory Committee, the completed nomination will be forwarded to the property owner by certified mail. An accompanying letter will request the owner's comments regarding the historical significance of the property proposed for nomination.
(4) Responses to requests for comment described in (3) of this section, and comments from public agencies received through the clearinghouse in the Office of the Governor, must be presented to the Historic Sites Advisory Committee at the time relevant nominations are considered.
(5) The Historic Sites Advisory Committee shall thereafter evaluate properties recommended for nomination to the National Register of Historic Places to determine if they meet criteria set out in the Code of Federal Regulations at 36 CFR 60.
(6) After a nomination has been approved or rejected by the Historic Sites Advisory Committee for nomination to the National Register of Historic Places, a certified letter will be sent to the property owner notifying him of the committee's action.
