Section 11 AAC 09.300 - Commercial-use permit(a) A commercial-use permit from the department is required for a commercial recreation activity that does not appear on the list in 11 AAC 09.030.(b) A person applying for a commercial-use permit shall submit to the department(1) a completed application on a form provided by the department;(2) the fee as required by 11 AAC 210; and (3) proof of the applicant's comprehensive liability insurance coverage as required by 11 AAC 09.320.(c) The commissioner will, in the commissioner's discretion, issue a commercial-use permit if the commissioner determines that the issuance of the permit is consistent with law and the management plan.(d) Before issuance of a permit under this section, the applicant must provide proof of satisfaction to the department that the requirements for insurance and performance guarantees set out in 11 AAC 09.320 have been met.(e) The commissioner will issue a permit under this section for a term not to exceed one year. The term of the permit will be specified on the face of the permit and will be set consistent with the management plan for the area. The commissioner will issue the permit subject to specified terms and conditions. Each permit shall contain a specific description of the permitted activity.(f) A permit issued under this section is revocable at will. The department will revoke a permit for the following reasons:(1) the permit holder's failure to comply with law related to the permit or the terms or conditions of the permit;(2) the department's determination that the revocation is necessary to further the management plan for the area.(g) The department will, in its discretion, suspend a permit issued under this section for the same reasons that a permit is revocable under (f) of this section, if the department determines that the failure was minor or a suspension will better further the management plan for the area.
