Section 880-X-8I-.15 - Relocation Or Use Of Public Roads

Each application shall describe, with appropriate maps and cross-sections, the measures to be used to ensure that the interests of the public and landowners affected are protected if, under Rule 880-X-7B-.09 the applicant seeks to have the State Regulatory Authority approve --

(a) Conducting the proposed surface operations and impacts incident to an underground coal mine within 100 feet of the right-of-way line of any public road, except where mine access or haul roads join the right-of-way; or

(b) Relocating a public road.

On February 5, 2002, the Office of Surface Mining approved this rulemaking adopted by the commission on August 16, 2001. The effective date of this rule will be March 7, 2002.
