Section 880-X-8D-.08 - Relationship To Areas Designated Unsuitable For Mining
(1) Each application shall contain a statement of available information on whether the proposed permit area is within an area designated unsuitable for surface mining activities under Rule 880-X-7D or under study for designation in an administrative proceeding under that Rule.
(2) If an applicant claims the exemption in Rule 880-X-7C-.05, the application shall contain information supporting the applicant's assertion that it made substantial legal and financial commitments before January 4, 1977, concerning the proposed surface mining activities.
(3) An application that proposes to conduct surface coal mining operations within 100 feet of a public road or within 300 feet of an occupied dwelling must meet the requirements of Rule 880-X-7B-.09 or Rule 880-X-7B-.10 of these regulations, respectively.

On February 5, 2002, the Office of Surface Mining approved this rulemaking adopted by the commission on August 16, 2001. The effective date of this rule will be March 7, 2002.
