Section 880-X-10C-.13 - Hydrologic Balance: Water Quality Standard And Effluent Limitations
(1)
(a) All surface drainage from the disturbed area shall be passed through a sedimentation pond, a series of sedimentation ponds or other treatment facility before leaving the permit area.
(b) Other treatment facilities shall mean any chemical treatment system, such as flocculation or mechanical structures such as clarifiers that have a point source discharge and are utilized to prevent additional contributions of suspended solids to stream flow.
(2) Sedimentation ponds and other treatment facilities shall be maintained until the disturbed area has been restored and revegetated. In no case shall the structure be removed sooner than two years after the last augmented seeding.
(3) Exemptions to Rule 880-X-10C-.13(1)(a) may be granted by the State Regulatory Authority when --
(a) The disturbed drainage area within the total disturbed area is small; and
(b) The person who conducts the surface mining activities demonstrates that sedimentation ponds or other treatment facilities are not necessary for drainage from the disturbed areas to meet the effluent limitations set by applicable State and Federal water quality standards for downstream receiving waters.
(4) For purposes of this Rule only, disturbed area shall not include those areas in which only diversion ditches, sedimentation ponds, other treatment facilities, or roads are installed in accordance with this Part and the upstream area is not otherwise disturbed by the person who conducts the surface mining activities.
(5) Discharges of water from areas disturbed by mining activities shall be made in compliance with all applicable State and Federal water quality effluent limitation guidelines for coal mining.
