Section 820-1-2-.19 - Declaratory Rulings

The Secretary may, upon petition by any party substantially affected, issue a declaratory ruling or order with respect to the jurisdiction of the Secretary, the applicability to any person, property or state of facts of any order or rule of the Secretary, or with respect to the meaning and scope of any order or rule of the Secretary. Such petitions shall be in writing and shall state facts sufficient to show that petitioner is substantially affected by such order or rule. Petitions shall be filed with the Secretary in accordance with Rule 8-1-2 -.04, supra. Upon receipt of such a petition, the Secretary may set a date and time for the taking of oral argument or written comments.
