The criteria for negligence of a Board member in his/her duties are stated in the law: "Any Board member may be removed by the Governor after notice and hearing for incompetence, neglect of duty, malfeasance in office, or moral turpitude." The chairperson of the Board must contact any member who is neglecting his or her duties and inform him/her of specific concerns. If the Board member does not rectify the situation, the chairperson, with a majority vote of the Board, will ask for that individual's resignation. If the resignation is not forthcoming, the chairperson will inform the Governor of the charges. If the negligent Board member is the chairperson, the vice chairperson shall assume these responsibilities.
