Section 580-6-34-.10 - Due Process

It is the policy of the Department of Mental Health and Mental Retardation to afford all employees the opportunity to exercise their due process rights. Due process has been defined as the right to be presented with the charges/allegations that are being considered against an employee in regard to suspension or termination, and an effective opportunity to submit a response to the charges/allegations orally and in writing to the appointing authority. If the disciplinary action being contemplated is suspension, the appointing authority may designate a representative, to present the charges and receive the employee's oral response.
