Section 335-2-1-.25 - Computation Of Time

In computing any period of time prescribed by this Chapter or by Code of Ala. 1975, § 22-22A-7, the day of the event from which the designated period begins to run shall not be included. The last day of the period so computed shall be included, unless it is a Saturday, a Sunday, or a legal holiday, in which event the period runs until the end of the next day which is not a Saturday, a Sunday, or a legal holiday. A legal holiday includes New Year's Day, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Veteran's Day, Thanksgiving Day, Christmas Day, and any other day appropriated as a holiday by the President or the Congress of the United States, or the Governor of Alabama, or as prescribed in Code of Ala. 1975, § 1-3-8. With the exception of the initial filing of the appeal request, whenever a party has the right or is required to do some act or to take some proceedings within a prescribed period after the service of a notice or other paper upon the party and the notice or paper is served upon the party by mail, three days shall be added to the prescribed period.
