By a vote of 4-0 on April 22, 2010, the Commission determined pursuant to U.S.C. 552b(e) and § 9.107(a) of the Commission's rules that Affirmation of: U.S. Department of Energy (High-Level Waste Repository), Docket No. 63-001-HLW; U.S. Department of Energy's Petition for Interlocutory Review be held on April 23, 2010, with less than one week notice to the public. The item was affirmed.
