Notice of Final Results of Antidumping Duty Changed Circumstances Review: Oil Country Tubular Goods From the Republic of Korea

SUMMARY:

On July 18, 2016, the Department of Commerce (the Department) published the notice of initiation and preliminary results of the changed circumstances review of the antidumping duty order on oil country tubular goods from the Republic of Korea (Korea). In that notice, we preliminarily determined that Hyundai Steel Corporation (Hyundai Steel) is the successor-in-interest to Hyundai HYSCO (HYSCO) for purposes of determining antidumping duty cash deposits and liabilities. No interested party submitted comments on the preliminary results. For these final results, the Department continues to find that Hyundai Steel is the successor-in-interest to HYSCO.

Background

On February 24, 2016, Hyundai Steel informed the Department that, effective July 1, 2015, it merged with HYSCO and requested that the Department conduct an expedited changed circumstances review under section 751(b) of the Tariff Act of 1930, as amended, 19 CFR 351.216(c), and 19 CFR 351.221(c)(3)(ii), to confirm that Hyundai Steel is the successor-in-interest to HYSCO for purposes of determining antidumping duty cash deposits and liabilities. On July 18, 2016, the Department initiated this changed circumstances review and published the notice of preliminary results, determining that Hyundai Steel is the successor-in-interest to HYSCO.

Scope of the Order

The merchandise covered by the order is OCTG, which are hollow steel products of circular cross-section, including oil well casing and tubing, of iron (other than cast iron) or steel (both carbon and alloy), whether seamless or welded, regardless of end finish (e.g., whether or not plain end, threaded, or threaded and coupled) whether or not conforming to American Petroleum Institute (API) or non-API specifications, whether finished (including limited service OCTG products) or unfinished (including green tubes and limited service OCTG products), whether or not thread protectors are attached. The scope of the investigation also covers OCTG coupling stock.

Excluded from the scope of the order are: Casing or tubing containing 10.5 percent or more by weight of chromium; drill pipe; unattached couplings; and unattached thread protectors.

Final Results of Changed Circumstances Review

For the reasons stated in the Initiation and Preliminary Results, and because we received no comments from interested parties, the Department finds that Hyundai Steel is the successor-in-interest to HYSCO. As a result of this determination, we find that Hyundai Steel should receive the cash deposit rate assigned to HYSCO in the most recently completed segment of the antidumping duty order on OCTG from Korea. Consequently, the Department will instruct U.S. Customs and Border Protection to suspend liquidation of all shipments of subject merchandise produced or exported by Hyundai Steel and entered, or withdrawn from warehouse, for consumption on or after the publication date of this notice in the Federal Register at 6.49 percent, which is the current antidumping duty cash-deposit rate for HYSCO. This cash deposit requirement shall remain in effect until further notice.
