SUMMARY:

Notice is hereby given that the U.S. International Trade Commission has determined not to review an initial determination (“ID”) (Order No. 7) issued by the presiding administrative law judge (“ALJ”) on April 8, 2016, granting the complainants' unopposed motion to amend the complaint and notice of investigation to add two respondents.

SUPPLEMENTARY INFORMATION:

The Commission instituted this investigation on February 29, 2016, based on a complaint filed by Edgewell Personal Care Brands, LLC, of Chesterfield, Missouri, and International Refills Company, Ltd., of Christ Church, Barbados (collectively, “Complainants”). 81 FR 10277-78. The complaint alleges violations of section 337 of the Tariff Act of 1930, as amended, 19 U.S.C. 1337 (“section 337”), in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain diaper disposal systems and components thereof, including diaper refill cassettes, by reason of infringement of certain claims of U.S. Patent Nos. 6,974,029 and 8,899,420. Id. at 10277. The Commission's notice of investigation named as respondents Munchkin, Inc., of Van Nuys, California; Munchkin Baby Canada Ltd., of Brampton, Canada; and Lianyungang Brilliant Daily Products Co. Ltd., of Lianyungang, China. Id. at 10278. The Office of Unfair Import Investigations is not participating in this investigation. Id.

On March 31, 2016, Complainants filed an unopposed motion to amend the complaint and the notice of investigation in order to add two respondents: Lianyungang Rainbow Daily Products Co., Ltd., of Lianyungang, China; and Munchkin Asia Limited, of Hong Kong, China. Complainants argue that they learned through discovery that these parties are involved in the manufacture and/or sale for importation of the accused products in this investigation.

On April 8, 2016, the ALJ issued the subject ID and granted Complainants' motion to amend the complaint and the notice of investigation. No petitions for review were filed.

The Commission has determined not to review the subject ID.

The authority for the Commission's determination is contained in section 337 of the Tariff Act of 1930, as amended (19 U.S.C. 1337), and in Part 210 of the Commission's Rules of Practice and Procedure (19 CFR part 210).
