Plaintiff contends there is no genuine disputed issue as to any material fact on the issue of liability, that Plaintiff is entitled to partial summary judgment on the issue of liability as a matter of law; and further, that as a matter of law Defendant may not assert the defense of contributory negligence in this cause.
