Tracey, Daniel Guenther, Maria T. Nicholson, Corrinne R. Fogg, and Vahik Minaiyan (the “Complaint”). For the reasons stated in the accompanying Memorandum of Law, the Complaint should be dismissed in its entirety and with prejudice because under Rule 12(b)(6) Case 1:16-cv-11620-NMG Document 22 Filed 10/05/16 Page 1 of 4 2 of the Federal Rules of Civil Procedure, plaintiffs fail to state a claim upon which relief can be granted.
