P. 56, Defendants/Third-Party Plaintiffs J. C. Penney Properties, Inc. and J. C. Penney Corporation, Inc. (collectively, “J. C. Penney”) hereby submit this motion for summary judgment on the issue of liability in Count One of the third-party complaint (Dkt. No. 23) against Third-Party Defendant Folsom Construction, LLC (“Folsom”). The issue of damages can be reserved for trial. As set forth more fully in the accompanying memorandum of law, pursuant to the terms of a contract, Folsom is obligated to defend and indemnify J. C. Penney against the claims asserted by Plaintiff Ralph Seitz. WHEREFORE, J. C. Penney respectfully requests that this Court enter judgment on the issue of liability in Count One of J. C.
