Exhibits A and B are true and correct copies of the documents obtained by counsel for Real Parties. This motion will be based on this notice of motion, on the attached memorandumofpoints and authorities. MEMORANDUM OF POINTS AND AUTHORITIES This Court may consider matters that are properly the subject of judicial notice. Under Evidence Code section 459, appellate courts have the sameright and power to take judicial notice as do the trial courts. (Evid. Code, § 459; Crowley v. Katleman (1994) 8 Cal.4th 666, 672; Evans v. Pillsbury, Madison & Sutro (1998) 65 Cal.App.4th 599, 605, fn. 5.) Evidence Code section 459(a) provides: The reviewing court shall take judicial notice of (1) each matter properly noticed by the trial court and (2) each matter that the trial court was required to notice under Section 451 or 453. The reviewing court may take judicial notice of any matter specified in Section 452. The reviewing court may take judicial notice of a matter in a tenordifferent from that noticed by the trial court. Evidence Code section 452(c) provides that judicial notice may be taken of “official acts of the legislative, executive, and judicial departments ... of any state of the United States.” Section 452(c) also provides that judicial notice may be taken of any document published, recorded, or filed by any executive department. (See also Serrano v. Priest (1971) 5 Cal.3d 584, 591; Moore v. Superior Court (2004) 117 Cal-App.4th 401, 407 fn.5; Wolfe v.
