Freeman, Assistant Supervising Judge of Complex Litigation Courts of the Superior Court of California, County of Los Angeles, whom the Judicial Council Chair assigned as the coordination motion judge for the petition of coordination filed by Plaintiff Patrick McClanahan (“Plaintiff”), heard Plaintiff’s petition to coordinate this class action with another class action pleading similar causes of action against Defendant CIK Power Distributors, LLC (“Defendant”) filed in Los Angeles County Superior Court, McClanahan v. CIK Power Distributors, LLC., Case No. 20STCV00307 (“the McClanahan action”). Judge Freeman determined that good cause exists to coordinate the matters. Following argument at the hearing in which the parties conveyed that they had stipulated to coordinate the matters and set the venue in Placer County, and considering that this action has advanced more in litigation than the McClanahan action (which has been stayed), Judge Freeman recommended that Placer County is the appropriate venue in which the coordinated trial should proceed and that the Third Appellate District be the reviewing court with appellate jurisdiction. On or about July 15, 2020, Judge Freeman issued a minute order nunc pro tunc after reviewing his Final Ruling dated July 8, 2020 and added the following language to the July 8 ruling: “Any future hearings on the newly coordinated case(s) are advanced to this date and vacated.” Plaintiff was ordered to give notice. Pursuant to California Rules of Court Rule 3.529, a copy of this notice is being filed in both this action and the McClanahan action, submitted to the Chair of the Judicial Council, and served on each party in both matters.
