(“BAM”), by and through its undersigned attorneys and pursuant to FED. R. CIV. P. 12(f)(2), moves to strike immaterial and impertinent matter from Plaintiffs’ Opposition to BAM’s Motion to Dismiss. Specifically, BAM moves that the Court strike paragraphs 4 through 17 and 20 through 24 of the Declaration of Richard J. Oparil, as well as Exhibits 1 through 14 and 17 through 21 thereto. In support thereof, Books-A-Million tenders the memorandum in support filed contemporaneously herewith, which is incorporated by this reference as if fully set forth herein.
