P. 56 and Local Rule 105.2, hereby move this Court for summary judgment in favor of Defendants and state as follows: 1. On May 15, 2017, Defendant United States of America filed a Motion for Summary Judgment and Memorandum in Support of Defendant’s Motion for Summary Judgment. See ECF No. 59 and 59-1. 2. Defendants, May Hseih Blanchard, M.D. and Vadim V. Moroz, M.D. (“Defendants”) hereby adopt and incorporate by reference as if fully stated herein Defendant United States of America’s Motion for Summary Judgment (ECF No. 59), Memorandum in Support of Defendant’s Motion for Summary Judgment (ECF No. 59-1), and attachments and exhibits thereto.1 1 In it its Motion and Memorandum, Defendant the United States of America addresses the timeliness of Plaintiff’s claims against the United States under the Federal Tort Claims Act (28 U.S.C. § 2401(b).) Case 1:15-cv-03433-ELH Document 62 Filed 05/16/17 Page 1 of 3 3. Moreover, Plaintiff’s claims against Drs. Blanchard and Morozov are barred by Maryland’s three-year statute of limitations. MD. CODE ANN., CTS. & JUD. PROC. § 5-101. As discussed in Defendant United States of America’s Motion for Summary Judgment, which has been fully adopted and incorporated as if fully stated herein, Plaintiff’s claims against all Defendants accrued in either January 2012 or October 2012. Plaintiff filed the instant suit on November 10, 2015. As such, Plaintiff’s claims against Drs. Blanchard and Morzov are time barred. WHEREFORE, Defendants May Hseih Blanchard, M.D. and Vadim V. Moroz, M.D., respectfully request that the Court grant summary judgment in their favor.
