INTRODUCTION On August 6, 2018 Defendants Chicago Title Company, Chicago Title Insurance Companyand Investment Property Exchange Services, Inc, {collectively “Chicago Title Defendants”) served a Memorandum of Costs (“Cost Memorandum) secking recovery of $6,422.19 in costs against Plaintiffs Lorelei Mooney, as trustee and on behalf ofthe lerbert and Helen Schweiger Trust, ARI-DEFWEast & West 9, L.P., Gary Lamm and James Mieuli (collectively “Plaintiffs”). (Declaration of Kenneth J. Catanzarite, Esq. [“Catanzarite Decl.”], Exhibit A.) Forthe reasons detailed below, $1,297.24 in “Other” costs should be stricken and/or taxed from the total costs requested by Chicago Title Defendants. 1I. ARGUMENT & AUTHORITY A. Legal Standard. In ruling on a motion to tax costs, the trial court 1s to determine whether Code of Civil Procedure section 1033.5 expressly allows the particular itemized cost, and whether it appears properon its face. If so, the burden is on the objecting party to showthe cost to be unnecessary or unreasonable. Nelson v. Anderson (1999) 72 Cal App. 4th 111, 131, as modified on denial of reh'g (June 14, 1999). If a defendant’s requested costs appear proper on theirface, a party subject to liability for costs mayscck to reduce the claimed items or the amount ofthe claimed costs, based on the circumstances under which the costs were incurred. For example, costs recoverable under Code of Civil Procedure section 1032 are restricted to those that are (1) reasonably necessary to the conduct ofthe litigation and (2) reasonable in amount. Code Civ. Proc., § 1033.5(c)(2); Nelson, 72 Cal. App. 4th at 130. The total costs claimed may include unreasonable or unnecessary costs; and maytherefore be reduced to costs which are reasonable and necessary to the litigation. /d. Once items in a cost memorandum are properly objected to, the burden ofproof1s placed on the party claiming them as costs. Ludas v. California State Auto Assn. (1993) 19 Cal.App.4th 761, 774. Any doubt as to whether an objected to item of cost 1s reasonably necessary or reasonable in amount must be resolved in favor of the objecting party. The category of “Other” costs expressly allows for recovery of costs only where “required to be awarded to the prevailing party pursuant to statute” incident to prevailing in the action. Code Civ. Proc., § 1033.5(a)(16). Chicago Title Defendants seek $1,297.24 of “Other” costs which, per Defendants’ Worksheet, consists of $54.00 for parking, $471.94 for mileage, $156.00 for train fare, $13.00 for taxi fares, and $602.00 for Courtcall appearances. (Ex. A at manual page number 6.) Neither the Cost Memorandum nor the Worksheet identify a statutory basis requiring that these “Other” costs be awarded and Plaintiffs are aware of no statutory basis for same. The only travel expenses authorized by Section 1033.5 are those to attend depositions. Code Civ. Proc., § 1033.5(a)(3)(c). Certainly if the Legislature believed it appropriate to allow for recovery of travel expenses to attend court hearings it would have allowed for such in the statute - the necessary implication being that such costs are disallowed. Additionally, routine expenses for travel unrelated to depositions, such as parking fees, mileage, cab fare and train fare are not reasonably helpfulto the trial of fact, or reasonably necessary to the conduct of the litigation. Ladas, 19 Cal.App.4th at 775-776. Allowing recovery oftravel costs for hearings would undermine Section 1033.5 and Ladas. CourtCall costs are not identified as an allowable cost and are purely convenience costs. Convenience costs are administrative and overhead costs and, as such, are not awardable. Ladas, 19 Cal.App.4th at 774-775. As a result, the entirety of $1,297.24 must be disallowed. III. CONCLUSION For all ofthe foregoing reasons, Plaintiffs respectfully request the Court strike and/or tax $1,297.24 from the Cost Memorandum. DATED: August 21, 2018.
