UNDER THE LAW OF ENGLAND NOW COMES, plaintiff, ING Bank N.V. (“ING Bank”), and refiles this motion for partial summary judgment, pursuant to Fed. R. Civ. P. 56(a), regarding the validity of the maritime lien of OW Bunker (UK) Ltd (“OW Bunker”) for non – payment of bunkers against the defendant in rem, the M/V OCEAN HARMONY (“OCEAN HARMONY”), and the validity of OW Bunker’s assignment of that maritime lien to ING Bank under the law of England. As more fully set forth in ING Bank’s Statement of Uncontested Facts annexed hereto, the charterer of the OCEAN HARMONY ordered OW Bunker to supply bunkers to that vessel, thereby creating a maritime lien against the OCEAN HARMONY in favor of OW Bunker. The undisputed material facts further establish that the English Omnibus Security Agreement between ING Bank and OW Bunker, among others, absolutely assigned to ING Bank OW Bunker’s maritime lien and other rights against the OCEAN HARMONY. Lastly, it is undisputed that neither OW Case 1:16-cv-02923-KBF Document 56 Filed 08/11/16 Page 1 of 2 2 Bunker nor ING Bank have been paid for the bunkers OW Bunker supplied to the OCEAN HARMONY. For the reasons more fully set forth in ING Bank’s Memorandum of Law filed this date, the undisputed material facts and well-established principles of the United States General Maritime Law and the Law of England, this Court should enter partial summary judgment in favor of ING Bank and against the OCEAN HARMONY, concluding that ING Bank holds a valid and enforceable maritime lien against the OCEAN HARMONY, as a matter of law. WHEREFORE, ING Bank N.V. requests this Court grant this motion for partial summary judgment and rule that ING Bank holds a valid and enforceable maritime lien against the OCEAN HARMONY.
