(“HB Capital”), through counsel, respectfully move this Court to dismiss Defendant and Counter-plaintiff Centripetal Networks, Inc. (“Centripetal”)’s Counterclaims pursuant to Federal Rule of Civil Procedure 12(b)(6). HB Limited, through counsel, also respectfully moves this Court to strike Centripetal’s Third, Fourth, Fifth, Sixth and Eighth Affirmative Defenses pursuant to Federal Rule of Civil Procedure 12(f).
