Fielder, Esq., and respectfully request that the Court, pursuant to F.R.C.P. 65, and LCvR. 65.1, issue a temporary restraining order and preliminary injunction, staying the execution of a writ of restitution, dated February 15, 2017, issued by Defendant, District Court in and for the Eleventh Judicial District, State of Colorado, until a hearing on the Plaintiff’s request for preliminary injunction, or further order of this Court. Further, the Plaintiff requests that the Court issue a temporary restraining order and preliminary injunction, restraining the Defendant, WILMINGTON SAVINGS FUND SOCIETY, FSB, as Trustee for CARLSBAD FUNDING MORTGAGE TRUST, from any further proceedings in an attempt to evict the Plaintiff from her Property in the Chaffee County District Court, referenced under 2016CV35, while this matter is pending before this Honorable Court, or until further order from this Court. IT IS FURTHER ORDERED that the execution of the Writ of Restitution, dated February 15, 2017, issued by District Court in and for the Eleventh Judicial District, State of Colorado, is hereby stayed for a period not to exceed 14 days, unless before that time the Court for good cause, extends it for a like period or the adverse party consents to a longer extension, during which a hearing on the Plaintiff’s request for preliminary injunction shall be heard. IT IS FURTHER ORDERED that Defendant, Wilmington Savings Fund Society, FSB, as Trustee for CARLSBAD FUNDING MORTGAGE TRUST is enjoined from any further attempt to evict the Plaintiff, pending hearing of this matter on the Plaintiff’s motion for preliminary injunction, or further order of this Court.
