Ms. Garcia-Garrido does not why she fell. Ms. Garcia-Garrido’s complaint alleges she was injured on March 26, 2014 when she slipped and fell on an unknown object on the floor of Outback Steakhouse of Florida, LLC (“Outback”) store 3212 located in Las Vegas.1 Outback served interrogatories upon her and interrogatory 3 asked her to state how the fall happened.2 Her response, verified on June 28, 2016, stated “[w]hen Plaintiff got up from the table to leave, she took a few steps toward the exit, and slipped on an unknown substance that was on the floor….”3 Her response to interrogatory 4 confirmed she “did not observe the substance on the floor prior to her slip and fall.”4 On October 4, 2016 at 5:17 p.m. Ms. Garcia-Garrido supplemented her response to interrogatory 3. She now stated when she “got up from the table to leave, she took a few steps toward the exit, and believes she slipped on a tomato-like substance that was on the floor….”5 Her response to interrogatory 4 was unchanged. Ms. Garcia-Garrido was deposed on October 5, 2016. During the deposition, she drew a diagram indicating where she had been seated and where she fell in the front-of-house dining area.6 Ms. Garcia-Garrido testified that she was on a date with a man named Jacques Ryland.7 She and Mr. Ryland had dinner, he paid for the meal, then they got up to leave the restaurant.8 Ms. Garcia- Garrido took about two or three steps when she slipped and fell.9 It “felt as though I stepped on something. I think it was probably a tomato or a piece of tomato.”10 When questioned further about 1 ECF No. 001-2 at ¶ 6. 2 ECF No. 040-1. Q: Did you ever look at the floor to see what may have caused you to fall? A: No, but I’m sure it was a piece of tomato because I felt - you know, tomato is kind of moist and has like a little - the skin is very slippery and just made me slide very quickly. I’m not sure. That’s really what I think. Q: It would be fair to say you think you slipped on a tomato, but you didn’t see it? A: No, I did not see it.11 Ms. Garcia-Garrido testified she does not know how long the object remained on the floor before she fell on it, and that she does not know how the object came to be on the floor.12 She agreed that the object could have been on the floor for thirty seconds, or it could have been on the floor for an hour before she slipped on it. 13 She testified that she had visited this Outback location before, and had not seen anything on the floor before.14 a. Mr. Ryland does not know what caused the fall. Jacques Ryland was deposed and also testified he was on a date with Ms. Garcia-Garrido when she slipped and fell.15 After they finished dinner, Ms. Garcia-Garrido started to walk towards the exit, and took about three steps when “[s]he slipped, and she went down to one knee.”16 Mr. Ryland did not see anything on the floor before she slipped and fell.17 He testified that he had been paying attention to his dinner, not to the floor, and that he “did not see anybody spill or hear anything [fall] on the floor.”18 Although a patron at a nearby table asked if Ms. Garcia-Garrido was alright after she fell, no one said anything about how the object on the floor came to be there.19 b. Outback does not know what caused the fall. Outback itself has limited information about Ms. Garcia-Garrido’s fall. Both parties attempted to locate this witness for deposition, but were unsuccessful. II. The evidence gathered does not indicate Ms. Garcia-Garrido fell due to a negligent act by Outback as opposed to any other reason. This court has jurisdiction via diversity, so Nevada substantive law applies. “The owner or occupant of property is not an insurer of the safety of an invitee thereon, and in the absence of negligence, there is no liability.”21 “The mere fact that there was an accident or other event and someone was injured is not of itself sufficient to predicate liability. Negligence is never presumed but must be established by substantial evidence.”22 “The owner or occupant of property is not an insurer of the safety of a person on the premises, and in the absence of negligence, no liability lies.”23 When a foreign substance on the floor causes a patron to slip and fall, liability will lie only where 1) the business owner or one of its agents caused the substance to be on the floor; 2) if the foreign substance is the result of the actions of persons other than the business or its employees, liability will lie only if the business had actual notice of the condition and failed to remedy it; or 3) the business had constructive notice of the condition and failed to remedy it.24 Stated again, the evidence taken in the light most favorable to Ms. Garcia-Garrido indicates she fell. However, the fundamental problem for Ms. Garcia-Garrido is the lack of evidence about why she fell. This evidence is necessary to indicate that Ms. Garcia-Garrido fell due to some negligent act by Outback as opposed to some other reason not attributable to Outback. Ms. Garcia- Garrido’s own testimony about why was speculative because she did not actually see anything on the floor. The testimony from Mr. Ryland also does not state he saw anything on the floor. Outback itself has no indication as to why she fell. The available evidence does not indicate what hazard, if one existed at all, caused Ms. Garcia- Garrido to fall. Without this evidence, Ms. Garcia-Garrido cannot demonstrate that Outback itself 21 Gunlock v. New Frontier Hotel Corp., 78 Nev. 182, 185, 370 P.2d 682, 684 (1962). 22 Id. 23 Sprague v. The second alternative is to demonstrate Outback has actual knowledge of the hazard. Again, the available evidence does not indicate what the hazard was, let alone that Outback had knowledge of its presence. Ms. Garcia-Garrido cannot satisfy this alternative method either. The final alternative for Ms. Garcia-Garrido is to provide evidence that Outback had constructive knowledge of whatever it was that caused her fall because of prior, similar events. To prove constructive notice under Sprague, a plaintiff must show the existence of a virtually continuous hazardous condition.25 The evidence in Sprague demonstrated that spills occurred 30 or 40 times a day inside the store, and the floor had to be swept several times an hour to clear these spills.26 Thus, the spills were so frequent that they constituted an ongoing, continuous hazard.27 Again, the evidentiary problem for Ms. Garcia-Garrido is that no evidence has been gathered that indicates why she fell. Without this evidence, it is impossible to evaluate whether whatever caused Ms. Garcia-Garrido’s fall occurred so frequently at Outback 3212 so as to be a virtually continuous hazardous condition. III. Summary judgment is warranted because there is no genuine issue of material fact for trial. When construed in Ms. Garcia-Garrido’s favor, the evidence indicates she fell, but not why. Falls can happen due to non-negligent reasons, or no reason at all. As the plaintiff, Ms. Garcia- Garrido’s burden is to offer evidence that she fell due to a negligent act by Outback. However, the available evidence contains no inference of negligence. Plaintiff tried to grab the table to catch her fall and her left thumb bent backwards and broke. Plaintiff also injured her wrist and shoulder. In addition, Plaintiff’s left leg extended forward and she fell on her right knee. Plaintiff underwent a left shoulder arthroscopy, rotator cuff repair, subacromial decompression and trigger finger release. Plaintiff has a torn meniscus in her right knee and continues to have right knee pain. Due to continued pain in her right knee, Plaintiff has received corticosteroid injections. Plaintiff was scheduled to have surgery but her blood sugar levels were too high at the time. In addition, Plaintiff continues to suffer from mental anguish, depression and anxiety. Plaintiff cannot raise her right arm all the way up into the air. Plaintiff has limited lifting capability and cannot lift five (5) pounds. Plaintiff’s continues to have pain in her right knee and now has pain in her left knee. Discovery is ongoing and Plaintiff reserves the right to supplement this response. PHILIPPUS: 25· · · · · ·Q.· · ·After Linda fell, did you help her get back Case 2:16-cv-01294-CWH Document 40-5 Filed 06/09/17 Page 4 of 6 Page 13 ·1· ·up? ·2· · · · · ·A.· · ·Yes. ·3· · · · · ·Q.· · ·Did anyone else help you help her get back ·4· ·up? ·5· · · · · ·A.· · ·A waitress was walking by, you know, with, ·6· ·like, a tray.· I believe she was serving the table where the ·7· ·gentleman was that said, "Are you okay" or whatever, all ·8· ·right. ·9· · · · · · · · · She went by, and I believe she offered to 10· ·help.· She was carrying a food service tray.· And she said, 11· ·like, you know -- I think she volunteered. 12· · · · · · · · · I asked, Ms. Garcia, I mean, she got up. 13· ·Yeah.· I did definitely help her up, I mean, without a 14· ·doubt.· Because she was still -- I don't think she 15· ·recognized the severity of whatever it was that, you know, 16· ·she endured. 17· · · · · · · · · So the waitress came by, and I'm asking 18· ·Ms. Garcia, you know, "Are you okay?"· Then she got up, and 19· ·she determined, you know, how well she could walk or move, 20· ·you know. 21· · · · · · · · · And she went, you know, and she hesitated. 22· ·And I'm just, like, "Well, okay.· All right."· And then just 23· ·as we made it, you know, several steps -- it's not that 24· ·far -- the manager came by, and obviously, had witnessed 25· ·whatever.· I don't know if he witnessed the actual fall, but Page 14 ·1· ·he knew something happened, all right. ·2· · · · · · · · · And we made it to the left, and that's when ·3· ·he took the statement. ·4· · · · · ·Q.· · ·Okay. ·5· · · · · · · · · You mentioned earlier you didn't see anything ·6· ·on the floor when you guys were walking out.· Were you ·7· ·looking at the floor? ·8· · · · · ·A.· · ·Was I looking at the floor?· Well, ·9· ·obviously, because we were sitting on the same side of 10· ·the bench, on the same side of the table next to each 11· ·other. 12· · · · · · · · · I was on the outside.· She was on the inside, 13· ·okay.· So yeah.· Obviously, I looked at the floor to see 14· ·what sort of, you know ... 15· · · · · · · · · I think there was a little step.· I'm not 16· ·sure, all right.· But, of course, I looked at the floor to 17· ·see wherever I go anywhere. 18· · · · · · · · · Did I witness or notice anything on the 19· ·floor?· To the best of my recollection, again, I 20· ·remember it was a wood-colored, like, a Pergo floor, 21· ·slightly shiny.· I can't say that it would have appeared 22· ·wet or anything. 23· · · · · · · · · So I went down there.· I turned around, and I 24· ·helped her down the stairs. 25· · · · · ·Q.· · ·But you weren't, like, staring at the floor Page 15 ·1· ·and watching very carefully, were you? ·2· · · · · ·A.· · ·No.· I was not staring at the floor, no.
