(Docket No. 1.) The EEOC claims that North Memorial retaliated against a job applicant named Emily Sure-Ondara in violation of Title VII, 42 U.S.C. § 2000e, et seq. North Memorial is entitled to summary judgment because Ms. Sure-Ondara did not engage in protected activity and because North Memorial had a legitimate justification for revoking Ms. Sure-Ondara’s conditional job offer; there is no evidence in the record that would allow a reasonable factfinder to determine that North Memorial’s justification is pretext for intentional retaliation. North Memorial’s motion is based upon its memoranda of law and supporting affidavits and exhibits thereto, to be submitted in accordance with the Federal Rules of Civil Procedure, the Local Rules of the U.S. District Court for the District of Minnesota and the Court’s Amended Pretrial Scheduling Order, the arguments at the time of the hearing, and the entire record herein.
