(PolyMet) respectfully moves to dismiss Plaintiffs Center for Biological Diversity, Earthworks, and Save Our Sky Blue Waters’ (Plaintiffs) Complaint for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). Specifically, PolyMet contends that Plaintiffs lack standing to sue under Article III of the United States Constitution, and that their claims are not yet ripe for adjudication.
