R. Civ. P. 9(b); and (4) Allen has failed to allege a plausible basis for relief under Fed. R. Civ. P. 8(a)(2). The motion is based on this notice, the accompanying memorandum of points and authorities, the court file, the arguments of counsel, and any other matters that the court deems appropriate to consider.
