For all the reasons set forth in the accompanying Memorandum in Support of Plaintiffs’ Motion for Summary Judgment filed concurrently herewith, the regulation issued by the Centers for Medicare and Medicaid Services (“CMS”) and codified at 42 C.F.R. § 447.400 (the “Final Rule”) is contrary to 42 U.S.C. § 1396a(a)(13)(C) and invalid under the Administrative Procedures Act (the “APA”), 5 U.S.C. § 706, and Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., 467 U.S. 837 (1984). Plaintiffs request that the Court hold that the Final Rule is invalid on one or both of the following grounds: (1) the sixty-percent-threshold requirement fails steps one and two of the Chevron analysis; and (2) the Final Rule’s reliance on billed codes to calculate the sixty-percent- threshold requirement fails step two of the Chevron analysis. Consequently, Plaintiffs seek an order and judgment declaring that payments they received under 42 U.S.C. § 1396a(a)(13)(C) cannot be recouped based on this invalid regulations.
